Investment Funds

Increasingly clients wish to use offshore structures as vehicles for collective investment funds.

Their choice of vehicle may be influenced by matters such as whether the underlying investors are from civil law jurisdictions or common law, in which case they may prefer corporate structures rather than trusts. They may be influenced by tax issues such as the need for tax transparency or by other commercial criteria.

We have experience and expertise in the setting up and management of these structures including limited partnerships, unit trusts, expert funds and cell companies.

In recent years Jersey as a jurisdiction has developed its offering in these areas and has designed its regulatory regime with a view to being efficient and user-friendly.

In coming years this process will be further developed through "super expert" funds.

We act for a range of clients in these areas, from individuals to institutions. We are well placed to do so with our legal background, our knowledge of the regulatory regime and our great experience in the management and administration of all major asset classes, including real estate.

It is noticeable that notwithstanding recent tax changes in the UK in relation to offshore property unit trusts they still provide an attractive and flexible means of ownership.
